Terms of Service

The rules for using this Site and buying our digital products. Please read them before you buy.

By clicking any Buy button, completing checkout, or downloading any Product, you agree to these Terms.

Effective date: October 11, 2026. Bespoke Outfitters, LLC, a Texas limited liability company, doing business as First Mate (“First Mate,” “we,” “us”). support@1st-mates.com

1. Who we are

This Site and the products sold through it are provided by Bespoke Outfitters, LLC, a Texas limited liability company, doing business as First Mate. Contact: support@1st-mates.com. Your agreement is with Bespoke Outfitters, LLC only. No member, manager, employee, or agent of Bespoke Outfitters, LLC is a party to these Terms or personally responsible for its obligations.

2. Acceptance

You accept these Terms and Billing & All Sales Final when you click a Buy button on this Site or complete a purchase of a First Mate product (each product page and receipt links to these Terms), when you submit a form on the Site, or when you otherwise use the Site. Our Privacy Policy and Cookie Policy explain how we handle information. You must be at least 18 years old. If you do not agree, do not use the Site or buy a product. Purchases are processed by Gumroad, whose terms also apply to the transaction.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or buy a Product. The Site and the Products are not directed to children. If you use the Site or buy a Product for an organization, you confirm you have authority to bind it.

4. Definitions

“Products” means the digital files and templates sold through the Site, including The Captain’s Logbook, The Chart Room Kit, Ritual Cards, The Captain’s Prompt Pack, and the Founding Captains Bundle, and any updated version we provide to you. “Content” means all text, graphics, designs, formulas, templates, prompts, data, and other material on the Site or in the Products. “Site” means the website at 1st-mates.com. “First Mate Parties” has the meaning given in the Indemnification section. These definitions apply wherever the capitalized terms appear in these Terms.

5. Your Representations

By using the Site or purchasing any Product, you represent and warrant that: (a) you are at least 18 years old and legally competent to enter into these Terms; (b) you have the authority to bind any entity on whose behalf you act; (c) all information you provide is accurate and current; (d) your use of the Products will comply with all applicable laws; and (e) you will not use the Products for any unlawful, infringing, or harmful purpose.

6. What we sell

We sell digital files and templates: printable PDFs, a spreadsheet, and text prompts, delivered by download. We do not sell physical goods, software, an app, a subscription, or ongoing services. We do not currently offer an email newsletter. If we offer one, we may change, pause, or end it at any time without liability. We may in future announce other products, which will be sold under their own terms. Nothing on the Site is a promise to release any product.

7. Purchases, delivery, and all sales final

Prices are shown at checkout, and any applicable sales tax is added there. Products are delivered by download immediately after payment. All sales are final, subject only to the limited exceptions described in Billing & All Sales Final, which you accept by completing your purchase. Promotional codes may be limited by time or quantity and may be withdrawn once their limit is reached. We may correct errors in product descriptions, images, or prices at any time; the price shown at checkout before you pay is the price you pay. If you start a chargeback or payment dispute for a Product that was delivered as described, we may suspend your license while the dispute is open and end it if the payment is reversed.

8. License to what you buy

When you buy a product, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use it for your own planning, and for the internal planning of your own business, and to print copies for your own use. We keep all ownership of the product. You may not:

  • resell, share, give away, post, upload, or otherwise distribute the product or any part of it
  • put it in any library, marketplace, or shared drive where others can get it
  • remove copyright, trademark, or license notices
  • use it to create or train a competing product, or to train any artificial intelligence model
  • use it in any unlawful way

If you break these rules, the license ends automatically and we may take any action the law allows. If you buy for an organization, it is for use by one person unless the product page says otherwise.

9. Prompts and third-party tools

The Captain’s Prompt Pack contains text you paste into a third-party AI service of your choice. We do not provide, control, or endorse any AI service, and its terms and privacy practices govern your use of it. AI output can be wrong, incomplete, or inappropriate. Review it before you rely on it, and do not enter confidential, personal, or sensitive information into any AI service unless you have checked its terms. Spreadsheet and document names such as Excel or Google Sheets belong to their owners; we are not affiliated with them, and the Kit may require software you must obtain separately.

10. No guarantee of results; not advice

Our products, including the Dead Reckoning Score™ self-check, are general planning and reflection tools. They are not business, financial, legal, tax, HR, medical, or other professional advice, and they are not tailored to you. We do not guarantee any result, including any improvement in productivity, income, or any outcome you are working toward. How you use a product, and what you decide, is your responsibility. Consult a qualified professional for advice about your situation.

11. Assumption of Risk

You understand and agree that the Products are self-directed planning tools. All decisions you make based on the Products — business, financial, personal, or otherwise — are yours alone. You assume full responsibility for any outcome, and you waive any claim against the First Mate Parties arising from decisions you made using the Products.

12. Permitted use of the Site

You may use the Site for lawful, personal purposes. You may not:

  • scrape, harvest, or bulk-download the Site or its content
  • submit false, fraudulent, or third-party information without authorization
  • probe, scan, or test the Site’s security, or interfere with other users
  • transmit malware or misuse the Site in any other way

13. Electronic communications

By giving us your email address, you consent to receive communications from us electronically, including receipts and notices, and you agree that electronic records satisfy any requirement that they be in writing. Marketing email is sent only with your consent, and you may unsubscribe at any time.

14. Privacy

Our Privacy Policy explains what personal information we collect through the Site, how we use and keep it, and the choices you have. It is part of the agreement between you and us. Our Cookie Policy explains what the Site does and does not set in your browser.

15. Intellectual property

The Site, its text, design, the First Mate name and logo, the compass mark, the Captain’s Logbook, the Chart Room Kit, and our other products are owned by Bespoke Outfitters, LLC or its licensors and protected by copyright and trademark law. Dead Reckoning Score™ is claimed as a trademark. All rights not expressly granted are reserved.

16. Feedback and messages you send

If you send us ideas, suggestions, or feedback, we may use them for any purpose without paying you and without any obligation to you. Do not send us anything you consider confidential.

17. Third-party links

We do not control and are not responsible for third-party sites or services linked from the Site.

18. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site or any file will be uninterrupted, error-free, or free of harmful components, and you are responsible for your own device and file security.

19. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BESPOKE OUTFITTERS, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE OR ANY PRODUCT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO A PRODUCT OR THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM, WHETHER PAID TO US OR TO GUMROAD ON OUR BEHALF.

Some jurisdictions do not allow certain limitations, so some of this may not apply to you. These limits do not apply to liability that cannot be limited under applicable law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Bespoke Outfitters, LLC, and each of its members, managers, officers, employees, agents, contractors, licensors, successors, and assigns (collectively, the “First Mate Parties”) from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, awards, fines, penalties, settlements, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to: (a) your access to or use of the Site, the Products, or any Content; (b) your breach of these Terms; (c) your violation of any applicable law, regulation, or third-party right, including intellectual property, privacy, or publicity rights; (d) any content, data, or materials you submit through the Site or by email; (e) any unauthorized use of your credentials or device; (f) any claim by a third party relating to your use of the Products; or (g) your negligence or willful misconduct. You will not settle any claim subject to this section without the First Mate Parties’ prior written consent. The First Mate Parties may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate fully. This indemnity is in addition to, and not in lieu of, any other remedy available to the First Mate Parties, and survives termination of these Terms.

21. Dispute resolution and arbitration

Please read this section. It affects your legal rights, including your right to sue in court and to bring a class action.

Informal resolution first. Before filing any claim, send us a written description of the problem at support@1st-mates.com and give us thirty (30) days to resolve it.

Binding individual arbitration. Except as stated below, any dispute between you and us arising out of or relating to the Site, a product, or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect when the claim is filed (see adr.org). The arbitration may be conducted by video, phone, or written submissions. The Federal Arbitration Act governs this section, and the arbitrator will apply Texas law. Fees are allocated as the AAA Consumer Arbitration Rules provide. The arbitrator may award you any individual relief a court could.

Small claims and other exceptions. Either of us may bring an individual claim in small claims court in your county of residence or in Harris County, Texas, if it qualifies. Either of us may go to court to stop infringement or misuse of intellectual property.

No class actions. You and we may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not combine claims or preside over any class or representative proceeding. If this waiver is found unenforceable as to a claim, that claim will proceed in court and not in arbitration.

Right to opt out. You may opt out of arbitration by emailing support@1st-mates.com with the subject “Arbitration opt-out,” your name, and your order email within thirty (30) days after your first purchase or first acceptance of these Terms. If you opt out, disputes will be resolved in the state or federal courts sitting in Harris County, Texas, and you consent to their jurisdiction.

Time limit. To the extent permitted by law, any claim must be brought within two (2) years after it arises.

Changes to this section. Any amendment to this arbitration provision does not apply to disputes that arose before the amendment took effect.

Severability fallback. If any other part of this section is found unenforceable, that part is severed and the rest of this section remains in effect.

Nothing in this section prevents you from reporting a concern to a government agency.

22. Termination

You may stop using the Site at any time. We may suspend or end your access to the Site, or end your license to a Product, if you breach these Terms. When your license ends, you must stop using the Product and delete or destroy your copies. Ending your access does not entitle you to a refund except as stated in Billing & All Sales Final, and the provisions listed under Survival in the General Provisions continue to apply, together with the license restrictions, No guarantee of results, Assumption of Risk, Disclaimer of warranties, Limitation of liability, Governing law, and Dispute resolution sections.

23. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration. Nothing in these Terms limits any right you have under consumer-protection laws that cannot be waived, including rights under the Texas Deceptive Trade Practices–Consumer Protection Act. The Assumption of Risk, Indemnification, and Limitation of Liability sections do not waive or limit any such right.

24. Changes

We may change the Site or these Terms by posting a revised version with a new effective date. Continued use after a change is acceptance of it. For purchases already made, the Terms in effect at purchase govern that purchase. A change to the dispute resolution section will not apply to any dispute that arose, or that we had notice of, before the change took effect.

25. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, Billing & All Sales Final policy, and Cookies page, constitute the entire agreement between you and Bespoke Outfitters, LLC.

Assignment: You may not assign these Terms. Bespoke Outfitters, LLC may assign them freely.

Force Majeure: Bespoke Outfitters, LLC is not liable for failures caused by events outside its reasonable control.

Severability: If any provision is found invalid, the remainder stays in effect.

Survival: The indemnity, liability cap, arbitration, and intellectual property provisions survive termination.

Notices: Legal notices go to support@1st-mates.com. You consent to electronic notice.
